متطلبات إصلاح و تطوير المؤسسة البرلمانية في الجزائر

Abstract

تأسس البرلمان الجزائري وفق منظومة قانونية جعلت منه جهاز من أجهزة الدولة يقوم عليها النظام الدستوري الجزائري، وعليه فقد وفقت نوعا ما هاته الهيئة على الصعيد القانوني الناظم لهيكلة وسير العمل البرلماني، أما عمليا نلتمس ضعف وتهميش أداء نواب وأعضاء البرلمان، نظرا للإجراءات القانونية المفروضة عليها، وكذا الهيمنة الحكومية التي تحول دون القيام بعملها بالشكل المطلوب، وبالتالي يستدعي النظر إصلاح أداء المؤسسة التشريعية تمثيليا، إنتخابيا، تشريعيا، ورقابيا، كما يتطلب الأمر كذلك تدعيم هاته المؤسسة بواسطة آليات ووسائل تطويرية تعزز مكانة البرلمان الجزائري وتجعله في مصاف البرلمانات المرموقة دستوريا، سياسيا، ودوليا. The parliament institution has been established in Algeria during the constitutional steps and that according a legal system makes with it an apparatus of the state that the Algerian constitutional system stands on it. Since the constitution of 1963 till the constitutional amendment of 2016,so this institution has been a little bit succeeded on the legal field that organizes the structure and the function of the parliament ‘s work, but practically we find a weakness and a marginalization of the parliament members due to the procedures imposed on it and also the government ‘s dominance that makes an obstacle to do its work as it should be, Thus it needs a reform of the legislative institution representatively, electorally, legislatively and supervisorily .and also the case needs a support for this institution with developed mechanisms and instruments that supports the position of the Algerian parliament and makes it among the good and the successful parliaments in the world constitutionally, politically and internationally.
